PARC D'ATRACCIONS TIBIDABO, SAU is a corporation, reporting to the Barcelona City Council.

As a public municipal company, PARC D'ATRACCIONS TIBIDABO, SAU fits into the definition of ‘public sector’ established in section d) of article 3.1 of Royal Legislative Decree 3/2012 of 14 November, which approved the Amended Text of the Public Sector Contracts Act (hereinafter TRLCSP).

In this regard, PARC D'ATRACCIONS TIBIDABO, SAU is in an intermediate state of subjection to the TRLCSP, in light of its twofold condition of (i) being an awarding power (ii) not a public administration, pursuant to the terms of article 3.3 of the TRLCSP.

On the one hand, PARC D'ATRACCIONS TIBIDABO, SAU fulfils the defining notes of the awarding power, in so far as it was created to satisfy general interest need that are not industrial or corporative, and that one or more subjects that must be considered awarding power pursuant to article 3.3 of the TRLCSP finances its work, control its management or appoint more than half of the members of its governing, management or supervisory body.

On the other, PARC D'ATRACCIONS TIBIDABO, SAU cannot be considered a public administration under the terms defined in article 3.3 of the TRLCSP.

Consequently, in the awarding of contracts subject to standardised procurement, PARC D'ATRACCIONS TIBIDABO, SAU will be subject to the Public Sector not Public Administration Act, concretely article 190 of the TRLCSP, while for the awarding of contracts not subject to standardised procurement, PARC D'ATRACCIONS TIBIDABO, SAU, in accordance with article 191 of the TRLCSP, will be subject to its Internal Procurement Instructions approved by the company’s Board of Directors on 31 March 2008, in order to guarantee the principles of advertising, concurrence, transparency, confidentiality, equality and non-discrimination, which inspire all public procurement, which are established in the same act.

Likewise, both in standardised and non-standardised procurement, the PARC D'ATRACCIONS TIBIDABO, SAU will sign private contracts with its successful bidders, as established in article 20 of the TRLCSP.

The competent jurisdictional order for hearing preparatory proceedings until awarding in contracts subject to standardised procurement will be the administrative-contentious jurisdiction, while ordinary jurisdiction will be competent to hear all awarding proceedings in contracts not subject to standardised procurement, as well as the effects, compliance and termination of all private contracts.
